FIELD SOBRIETY TESTS

The Field Sobriety Test is a tool law enforcement use in building their DUI case against a person they suspect of driving under the influence. What officers are looking for is anything that will help support their argument that the person is operating a vehicle with a BAC (Blood Alcohol Content) of .08% or above.

The field sobriety test can often consist of a number of different tests including counting backwards, finger-to- nose, reciting the alphabet backwards, one leg stand, walk a straight line and turn, and following an object or light with eyes.

All of these tests are unique and present their own flaws. It is important for a person who failed a field sobriety test to consult with an experienced DUI attorney who understands how to argue the flaws of the various field sobriety tests. An experienced DUI attorney will be able to look at a number of factors and determine if the person’s failure of the tests were due to other factors such as preexisting injury, the condition of the road or surface the tests were administered on, the lighting, or other impairment the officer may not have known of at the time.
